摘要：2015年和林格爾縣作為試點(diǎn)，征地補(bǔ)償安置爭(zhēng)議裁決利修法創(chuàng)新研究至關(guān)重要，是我們征地補(bǔ)償安置爭(zhēng)議裁決工作的重中之重，更是征地改革的一個(gè)難點(diǎn)。本文基于對(duì)征地補(bǔ)償安置爭(zhēng)議裁決制度的理論研究，以及進(jìn)行國(guó)內(nèi)外法律法規(guī)比較分析，對(duì)理論概念的梳理和改革實(shí)踐過(guò)程中的問(wèn)題研究。提出了比較全面完善的關(guān)于我國(guó)征地補(bǔ)償安置爭(zhēng)議裁決制度的方案，對(duì)征地補(bǔ)償安置爭(zhēng)議裁決提出了幾點(diǎn)利修法建議：1明確裁決決定的效力2對(duì)征地補(bǔ)償標(biāo)準(zhǔn)做出明確規(guī)定3讓仲裁機(jī)構(gòu)發(fā)揮作用4將決裁制度規(guī)范統(tǒng)一，以用于完善土地征收補(bǔ)償安置爭(zhēng)議裁決的試行制度。

　　Abstract：The quality of land compensation and resettlement affects the vital interests of the peasants who have been expropriated，and also relates to the country’s economic development，and relates to the long-term stability of the country indirectly. In 2015，Helingeer County as a pilot，Land requisition compensation and resettlement dispute on the innovation of amending the law is essential，and also is a difficult point of land expropriation reform. This paper puts forward a comprehensive improvement on China’s land requisition compensation and resettlement dispute adjudication system by doing a comparative analysis of domestic and foreign laws and regulations based on the theory of land requisition compensation and resettlement dispute adjudication system. Through the study of problem analysis and reform practice of theoretical concepts of the land requisition compensation and resettlement dispute adjudication and put forward some suggestions about how to amend the law conducively. The paper puts forward some suggestions on amending the law of land requisition compensation and resettlement dispute ruling through combing the theoretical concepts and reforming the problems in the process of practice. Firstly，explicit the validity of adjudication decision. Secondly，make a clear provision on the land compensation system. Thirdly，Let arbitration institution to be effective；Fourthly，The system of adjudication shall be standardized and unified for the purpose of improving the trial system for the compensation，resettlement and adjudication of land expropriation.

　　自2015年3月20日，國(guó)務(wù)院確定全國(guó)農(nóng)村土地征收制度改革試點(diǎn)縣，和林格爾縣作為試點(diǎn)縣之一，征地補(bǔ)償安置爭(zhēng)議更是重中之重。論文以和林格爾縣征地補(bǔ)償安置爭(zhēng)議裁決立修法為例，通過(guò)分析目前的征地補(bǔ)償安置爭(zhēng)議裁決利修法的現(xiàn)狀以及現(xiàn)存的問(wèn)題并給出了自己的建議。
　　1.和林格爾縣試點(diǎn)情況
　　2015年2月27日，第十二屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第十三次會(huì)議確定和林格爾縣為全國(guó)農(nóng)村土地三項(xiàng)制度改革試點(diǎn)縣，并確定其為全國(guó)農(nóng)村土地征收制度改革試點(diǎn)縣。委審慎穩(wěn)妥推進(jìn)改革試點(diǎn)工作，確保征地補(bǔ)償順利進(jìn)行，該縣制定了《和林格爾縣征地補(bǔ)償安置爭(zhēng)議協(xié)調(diào)裁決規(guī)定（試行）》等，對(duì)于解決補(bǔ)償安置正疑問(wèn)題專門建立了“裁委會(huì)”，是農(nóng)民能夠大聲表達(dá)訴求，協(xié)調(diào)和化解土地征收中的矛盾糾紛，委員會(huì)成員突破縣級(jí)行政層面，加入了區(qū)、市國(guó)土部門領(lǐng)導(dǎo)和區(qū)、市、縣法律顧問(wèn)，避免縣政府既是征地補(bǔ)償方案的制定者，又是征地補(bǔ)償爭(zhēng)議的裁決者。
