介紹中國(guó)法律作文
眾所周知,中國(guó)文化源遠(yuǎn)流長(zhǎng)、博大精深。法律文化也是中華文化的重要組成部分,且經(jīng)過(guò)各個(gè)朝代的不斷演化與當(dāng)代中國(guó)的發(fā)展,呈現(xiàn)出一種繁榮的局面。
首先:中國(guó)古代法律是諸法合體,以刑為主,在各種法律規(guī)范中,刑法是一支獨(dú)秀,受到歷代統(tǒng)治者的倍加關(guān)注。其中讓我印象比較深刻的是車(chē)裂、剝 皮、烹 煮等非常殘酷的刑罰。中國(guó)古代刑法文化源遠(yuǎn)流長(zhǎng),為中國(guó)的奴隸社會(huì)、封建社會(huì)和半封建半殖民地社會(huì)形態(tài)的演變和發(fā)展作出了巨大的貢獻(xiàn)。中國(guó)古代法律也是是“禮治”與“法治”相結(jié)合的法律傳統(tǒng)。
當(dāng)代中國(guó)的法律體系通常包括下列部門(mén):憲法、行政法、民法、商法、經(jīng)濟(jì)法、勞動(dòng)法與社會(huì)保障法、自然資源與環(huán)境保護(hù)法、刑法、訴訟法。這些法律共同組成了中國(guó)特色社會(huì)主義法律體系。
1. 憲法作為一個(gè)法律部門(mén),在當(dāng)代中國(guó)的法律體系中具有特殊的地位,是整個(gè)法律體系的基礎(chǔ)。
2. 刑法是規(guī)定犯罪和刑罰的法律,是當(dāng)代中國(guó)法律體系中一個(gè)基本的法律部門(mén)。
3. 行政法是調(diào)整國(guó)家行政管理活動(dòng)中各種社會(huì)關(guān)系的法律規(guī)范的總和。
4. 民法是調(diào)整作為平等主體的公民之間、法人之間、公民和法人之間等的財(cái)產(chǎn)關(guān)系和人身關(guān)系的法律。
5. 商法是調(diào)整平等主體之間的商事關(guān)系或商事行為的法律
6. 經(jīng)濟(jì)法是調(diào)整國(guó)家在經(jīng)濟(jì)管理中發(fā)生的經(jīng)濟(jì)關(guān)系的法律。
7. 勞動(dòng)法是調(diào)整勞動(dòng)關(guān)系的法律,社會(huì)保障法是調(diào)整有關(guān)社會(huì)保障、社會(huì)福利的法律。
